DA 97-64 January 10, 1997 TEXAS 18 - EDWARDS, RSA 669 A LICENSE WITHDRAWN FROM CELLULAR UNSERVED AREA AUCTION Report No. CL-97-19 Market R669 A - Texas 18 - Edwards RSA The Texas 18 - Edwards license, CDR669A (market R669 A - Texas 18 - Edwards RSA), is hereby withdrawn from Auction No. 12 (cellular unserved areas), scheduled to begin on January 13, 1997, due to lack of mutual exclusivity. Texas #20 Rural Cellular, Inc. and GCC License Corp. (a wholly-owned subsidiary of Western Wireless Corp.) filed mutually exclusive Phase I unserved area applications. In accordance with Sections 22.129 and 22.949(c) of the Commission's rules, these parties have filed a full market settlement. The settlement agreement and related documents have been reviewed and are hereby approved pursuant to Sections 22.129 and 22.949(c) of the Commission's rules. In accordance with Section 22.128(a) of the Commission's rules, GCC License Corp.'s Phase I application (file number No. 07666-CL-P1-95) is dismissed without prejudice leaving Texas #20 Rural Cellular, Inc. (file No. 01287-CL-P1-97) as the sole applicant in this market. Texas #20 Rural Cellular, Inc. must submit the following items to the Office of the Secretary, Federal Communications Commission, Washington, D.C. 20554. 1. The original and two paper copies of its FCC Form 401 application within seven (7) days of the date of this Public Notice as required by Section 22.929 of the Commission's rules, 47 C.F.R.  22.929. The application must be enclosed in stiff covers and fastened securely along the left edge without exposed sharp edges. There will be no filing fee required because the fee was paid when the microfiche application was filed. Additionally, due to the fact that the Commercial Wireless Division processes only FCC Form 600 applications for unserved area applications, Texas #20 Rural Cellular must also submit a fully completed FCC Form 600. Any Section 1.65 amendments within 30 days of the date of this Public Notice, including all amendments reflecting the full market settlement.
